Prescott Valley Concrete Company is a licensed concrete contractor based in Prescott Valley, AZ. We provide residential and commercial concrete services including, but not limited to, driveway installation, patio construction, foundation work, flatwork, and related concrete services. The Site is provided for informational purposes and to allow prospective customers to request estimates and contact us. Use of the Site does not create a contractual obligation on either party. A formal service agreement is established only when both parties have agreed in writing to a specific scope and price.
Any estimate or quote we provide is based on the information available at the time of the site visit. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
Changes to the scope of work requested by the customer after an estimate has been accepted may result in adjustments to the price. We will notify the customer of any material cost changes before proceeding with additional work.
Unforeseen site conditions - such as undiscovered underground utilities, caliche layers requiring additional excavation, or other subsurface conditions not visible at the time of the estimate - may result in additional charges. We will communicate any such conditions and associated costs to the customer prior to proceeding.
Scheduling is subject to crew availability, permit timelines, and weather conditions. We will communicate estimated start dates in good faith, but specific start dates are not guaranteed unless confirmed in a written agreement.
We reserve the right to reschedule work due to weather conditions that would compromise the quality of the concrete pour or the safety of our crew. In the case of weather-related delays, we will contact the customer promptly and propose a revised schedule.
If a customer wishes to cancel a scheduled project, they must notify us in writing as soon as possible. Cancellation terms, including any deposit refund conditions, will be specified in the written service agreement.
Payment terms will be specified in the written service agreement for each project. Typically, a deposit is required before work begins, with the remaining balance due upon completion unless otherwise agreed in writing.
Invoices not paid within the agreed timeframe may be subject to late fees as specified in the service agreement. We reserve the right to suspend or cease work on a project if payment obligations are not met.
In the event that collection action becomes necessary to recover unpaid amounts, the customer agrees to pay all reasonable costs of collection, including attorney fees, to the extent permitted by applicable law.
Where required by local ordinance, we will obtain the necessary building permits before commencing work. Permit fees will be included in or added to the project estimate. The customer is responsible for ensuring that any applicable homeowners association (HOA) approvals are obtained prior to the start of work. We are not responsible for HOA violations arising from a customer proceeding with work without the necessary HOA approval.
To the maximum extent permitted by applicable law, Prescott Valley Concrete Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of the Site or the performance of services, including but not limited to loss of profit, loss of data, or loss of use.
Our total liability for any claim arising out of or relating to a specific project shall not exceed the total amount paid by the customer for that project. Nothing in these terms limits liability that cannot be excluded under applicable law.
The Site and its contents are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
Any warranty applicable to workmanship or materials will be specified in the written service agreement for the specific project. Concrete, as a material, is subject to natural characteristics including minor hairline cracking, color variation, and surface texture variation that are inherent to the material and do not constitute defects.
No warranty is provided against damage caused by misuse, alterations, failure to follow care instructions, acts of nature, or conditions outside our control after project completion.
In the event of a dispute arising out of or related to these Terms or any service we provide, the parties agree to first attempt to resolve the matter through good-faith direct communication. If direct communication does not resolve the dispute within 30 days, the parties agree to pursue mediation before initiating any legal action.
If mediation does not resolve the dispute, either party may pursue their legal remedies as set forth below under Governing Law.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Yavapai County, Arizona, and you hereby consent to personal jurisdiction and venue in those courts.
You may use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to use the Site to transmit any unlawful, harmful, threatening, abusive, or defamatory content. You may not attempt to gain unauthorized access to any portion of the Site or its related systems.
We reserve the right to terminate access to the Site for any user who violates these Terms or who uses the Site in a manner we determine is harmful to others or to our business.
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site.
